While most every lawyer will be on your side in a case, there will be a few that for whatever reason will prove negligent, either in a court proceeding or in the auto crash settlement process. For most lawyers, their causes will be aligned with yours because the bigger settlement you get, the bigger fee they will get. However, some will settle your case early for the chance to get more cases done or because the marginal amount of money won’t mean much more to them for the time invested. The best prevention to this is being prepared, so follow these steps whenever you deal with your lawyer.

Whiplash cases can sometimes be confusing and there are several ways that a lawyer could be negligent when handling your case. First, he could feed you the wrong information about the case, telling you that you would get a much bigger reward than you did just to get you to sign with him after the free consultation. He could also not give your case the same consideration he is giving other, more expensive cases, which results in your case being settled for less pain and suffering damages He could also settle the case quicker and for less money than you would have liked just so he can turn over more cases. And finally, your lawyer, if he’s working on a fee basis, could even overbill you for hours worked. If any one of these happens and you can prove it, you may be able to take you lawyer to court to collect damages from him.

However, if you want a chance of winning your court case, you have to be prepared for the worst from the time you meet your attorney the first time. From the time you first meet your whiplash lawyer until you are done with your case and satisfied, make sure that you keep track of everything that the lawyer does. This includes any papers that you get sent and any notes on any meetings you have with the lawyer. If possible you can also tape the conversations the two of you have, but make sure that the lawyer knows he is being taped before you start recording. Many times, if an attorney is untrustworthy, knowing that his client is active in the case and has all his stuff recorded, it will be enough to make sure that he doesn’t do anything wrong.

If you think your attorney was negligent and you have the papers and documentation to prove it, your next step is to hire a negligence attorney. He will be able to take your old lawyer to court to sue for damages that he caused you by mishandling your case. This is where the information that you collected comes in handy. The burden of proof will be on you to prove that your lawyer was negligent, so you will have to submit evidence that proves that your old lawyer was negligent after a preponderance of the evidence. Make sure that you keep tabs on this lawyer as well!

Getting compensated for damages by a negligent attorney is possible, but I can be extremely difficult. The easier way to go is to make sure that you don’t get into the problem in the first place. Always ask around with family members and friends to see if they know a good attorney from personal experience or one of their friends. And no matter who you get the recommendation from, make sure that you stay actively involved in your case and keep all the documentation related to it. This will help to increase your settlement and keep the lawyer honest and help you know what is going on with your trial.
